Terms of Service

The terms that govern your use of Simjot.

These Terms of Service (the “Terms”) govern your access to and use of Simjot (“Simjot”, “we”, “us”, “our”), a chat, community, and support product operated by Gillside Solutions, 7 Temasek Boulevard #12-07 Suntec Tower One, Singapore 038987. They apply to the Simjot website (simjot.com), the Simjot web application, and related services (together, the “Service”).

1. Acceptance of these Terms

By creating an account, accessing, or using the Service, you agree to be bound by these Terms and by our Privacy Policy, which is incorporated here by reference. If you do not agree to these Terms, you must not use the Service.

2. Eligibility and age

The Service is not directed to young children. Simjot applies age-gating, and some features and communities are restricted based on age. To use the Service you must meet the minimum age required in your country and provide accurate age information when asked.

Where younger users are permitted to use the Service, additional protections apply, and we expect a parent or legal guardian to be involved in and consent to a minor’s use of the Service. If you are a minor, you may use the Service only with such involvement and consent. We may suspend or remove accounts that do not meet our eligibility requirements.

3. Your account and handle

To use most features you must create an account with a unique handle (username) and, where applicable, sign in using a supported method. You are responsible for the activity that happens under your account and for keeping your credentials secure. You must provide accurate information and keep it up to date.

You may not impersonate others, use a handle you do not have the right to use, share your account, or transfer it without our permission. Notify us promptly of any unauthorised use of your account.

4. Acceptable use and prohibited conduct

You agree not to use the Service to:

  • break any applicable law, or infringe the rights of others, including intellectual property and privacy rights;
  • post or share content that is unlawful, harassing, hateful, abusive, threatening, defamatory, obscene, or that exploits or endangers minors;
  • send spam, scams, malware, or other unsolicited or harmful communications;
  • attempt to gain unauthorised access to the Service, other accounts, or our systems, or to disrupt or overload the Service;
  • scrape, harvest, or collect data about other users without their consent, or circumvent any access controls or rate limits;
  • misrepresent your identity or affiliation, or evade a suspension or ban.

5. User content and moderation

You retain ownership of the messages, posts, and other content you create or share through the Service (“User Content”). You grant us a limited, worldwide, non-exclusive, royalty-free licence to host, store, transmit, and display your User Content solely as needed to operate and provide the Service to you and the people you communicate with.

You are responsible for your User Content and must have the rights necessary to share it. We may review, moderate, restrict, or remove content, and suspend or terminate accounts, where we reasonably believe content or conduct violates these Terms or applicable law, or to protect the safety of our users and the Service. We are not obligated to monitor all content but may do so.

6. Automated message screening, demerits, and suspension

To enforce these Terms and keep the Service safe, messages and other content you submit are automatically screened at the time you post them against a maintained list of disallowed terms and patterns (for example profanity, abusive or threatening language, and content that could endanger a minor), together with basic abuse and spam checks. Content identified this way may be blocked before it is sent, flagged, or removed, and you may not attempt to evade this screening (for example by disguising or obfuscating disallowed terms).

Violations can result in demerit points being applied to your account and handle. Demerit points accumulate over a rolling period, and once your total reaches a set threshold your account is suspended. Because suspension is applied at the account level, it affects every handle associated with your account. More serious violations carry heavier consequences: seriously abusive content can reach the suspension threshold on its own, and the most severe safety violations — in particular content that sexually exploits, solicits, or otherwise endangers a minor — result in an immediate and permanent ban and may be reported to the relevant authorities.

Suspension and bans are enforcement actions to protect the Service and our users; we do not guarantee an appeals process, and we may take these actions with or without prior notice. How we process content for this screening is described in our Privacy Policy.

7. Third-party services

The Service integrates with third-party services so that certain features work:

  • Google — sign-in (OAuth) where you choose to use it.
  • Meta / WhatsApp — optional mobile phone number verification, sent as a one-time message over WhatsApp, which is provided by Meta Platforms, Inc.

Your use of these third-party services is also governed by their own terms and privacy policies. We are not responsible for third-party services, and your dealings with them are between you and the relevant provider.

8. Privacy

Our Privacy Policy explains how we collect, use, and protect your personal data. You can request deletion of your account and data as described in our Data Deletion Instructions.

9. Disclaimers

The Service is provided on an “as is” and “as available” basis, without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure, or that any content is accurate or reliable. You use the Service at your own risk.

10. Limitation of liability

To the maximum extent permitted by law, Gillside Solutions and its officers, employees, and suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, goodwill, or other intangible losses, arising out of or relating to your use of (or inability to use) the Service. Our total aggregate liability for any claim relating to the Service will not exceed the greater of the amount you paid us to use the Service in the twelve months before the claim, or one hundred Singapore dollars (SGD 100).

11. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access to the Service, in whole or in part, with or without notice, if you breach these Terms, if required by law, or to protect the Service or our users. On termination, your right to use the Service ends. The provisions that by their nature should survive termination (including content licences for already-shared content, disclaimers, limitations of liability, and governing law) will survive.

12. Changes to the Service and these Terms

We may change, suspend, or discontinue parts of the Service at any time. We may also update these Terms from time to time. When we make material changes, we will update the “Last updated” date at the top of this page and, where appropriate, provide additional notice. Your continued use of the Service after an update means you accept the revised Terms.

13. Governing law

These Terms are governed by the laws of Singapore, without regard to its conflict of laws rules. The courts of Singapore will have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the Service, subject to any mandatory rights you have under the law of your country of residence.
